Terms & Conditions
These Terms & Conditions govern your access to and use of PERKS Business, PERKS Wallet, loyalty programmes, campaigns, analytics, integrations and related services.
1. Acceptance of these Terms
By creating an account, accessing or using PERKS, connecting an integration, or using a PERKS feature, you agree to these Terms & Conditions and the policies linked from them. If you use PERKS on behalf of a business or organisation, you confirm that you are authorised to accept these Terms on its behalf.
2. The PERKS Service
PERKS provides digital loyalty, customer-engagement, campaign, analytics and merchant-management infrastructure. PERKS is not a bank, lender, stored-value wallet, payment processor, or point-of-sale system. Payment services and other third-party services may be provided by independent providers under their own terms.
3. Accounts and security
- Provide information that is accurate and reasonably current.
- Keep authentication credentials and devices secure.
- Do not impersonate another person or use information you are not authorised to use.
- Notify PERKS promptly if you suspect unauthorised access or misuse.
You are responsible for activity carried out through your account to the extent permitted by applicable law.
4. Loyalty programmes, stamps and rewards
Merchant-controlled rules determine eligibility, minimum purchase requirements, stamp values, reward thresholds, expiry and redemption. PERKS provides the infrastructure for these programmes but does not guarantee that a particular merchant will continue a programme, honour an expired reward, or maintain a particular offer.
5. Campaigns and communications
Businesses are responsible for the content of campaigns, audience selection, consent, lawful communication practices and compliance with applicable anti-spam and messaging requirements. PERKS may restrict or suspend campaigns that create security, fraud, legal, spam or platform-policy risks.
6. AI-assisted features
PERKS may provide AI-assisted campaign drafting, summaries, analytics, segmentation suggestions or similar features. AI output may be inaccurate or incomplete and must be reviewed before use. You must not submit information that you are not authorised to process.
7. Third-party services and integrations
PERKS may integrate with services such as Google, Gmail, payment providers, hosting providers, communications providers and AI providers. Those services are subject to their own terms, privacy policies and availability. An outage or change in a third-party service may affect the corresponding PERKS feature.
8. Fees, subscriptions and payments
Subscription prices, taxes, trial periods, billing frequency, plan limits and renewal details are displayed at the relevant purchase or subscription screen. Payments may be processed by a third-party payment provider. Refunds and cancellations are governed by the applicable refund/cancellation terms and any mandatory rights under law.
9. Acceptable use
You must comply with applicable law and must not use PERKS to commit fraud, manipulate loyalty activity, obtain rewards improperly, gain unauthorised access, distribute malicious code, scrape or disrupt the service, abuse communications channels, or bypass security controls.
10. Intellectual property
PERKS software, trademarks, interfaces, visual design, documentation and underlying technology are owned by or licensed to PERKS. You retain rights in content you lawfully submit, subject to the limited rights necessary to provide, secure and improve the service.
11. Availability and changes
PERKS may improve, modify, suspend or discontinue features. We aim to provide a reliable service but do not guarantee uninterrupted, error-free operation or compatibility with every device, browser, network or third-party service.
12. Suspension and termination
Access may be suspended or terminated for non-payment, security risk, fraud, unlawful activity, abuse, policy violations or operational risk. Where reasonably practicable, PERKS may provide notice and an opportunity to address a non-critical violation.
13. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, PERKS is provided on an as-available basis and does not guarantee a particular revenue, retention, conversion, campaign or business outcome. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
14. Governing law and disputes
These Terms are governed by the laws applicable in India, subject to mandatory rights available under applicable law. Any dispute will be handled by a competent forum having jurisdiction under applicable law. If a specific contractual venue is required, the operator should insert its actual legal entity and registered-office jurisdiction before launch.
15. Changes to these Terms
We may update these Terms when the service, law or operational requirements change. Material changes may be communicated through the service or another reasonable channel. Continued use after an effective update constitutes acceptance to the extent permitted by law.
